Who these terms are with
These terms are an agreement between you and Open Hearts ("we", "us"), whose address is under Contact. They cover this site, the game at play.openhearts.game, the Open Hearts apps for phones, and the live-play service. By using any of them you agree to these terms. If you do not agree, please do not use them.
How we handle information about you is in the privacy policy, which is part of these terms.
If you got the app from the App Store
If you downloaded Open Hearts from Apple's App Store, your licence to use the app is Apple's Licensed Application End User License Agreement (the "Standard EULA"), between you and us. These terms add to it; where they disagree about the app itself, the Standard EULA wins. Apple is not a party to these terms and is not responsible for the app or its support. Anything you buy in the App Store is billed, renewed, cancelled and refunded by Apple, under Apple's own terms.
If you got it from Google Play, Google Play's terms apply to the download and to anything bought there in the same way.
Playing alone
Playing against the bots is free, needs no account, and has no ads or purchases in it. We do not promise to keep any particular version of it running, but the code is open, so anyone can.
The live-play subscription
What it includes
- Being seated at a table with other subscribers who are waiting, with bots in the seats nobody takes.
- Tables of your own, with a link to send to friends who also subscribe.
- Rated games, and a rating worked out from results everyone at the table signs.
- The services that make a table work: putting devices in touch with each other, relaying the traffic between them, and jurors that keep a table going.
- Up to five of your devices on one subscription, added and dropped by you.
Everyone at a live table has subscribed. Live play needs an internet connection; what it shares, and with whom, is in the privacy policy. We do our best to keep it working, but we cannot promise that it always will, or that a particular game will finish.
Price and length
A subscription lasts one year and costs $5.99 a year in US dollars on the web, paid up front, plus any tax shown at checkout. In the App Store or Google Play the price is the one the store shows you, in your currency, before you buy.
Automatic renewal
A subscription renews automatically every year, at the price then in force, and is charged to the same payment method, until you cancel it. If the price changes, the new price applies only from your next renewal, and the store, or for the web we, will tell you before it does.
- App Store: payment is charged to your Apple Account when you confirm the purchase. The subscription renews unless it is cancelled at least 24 hours before the end of the current year, and your account is charged for the renewal within the 24 hours before that.
- Google Play: renewal and charging follow Google Play's rules, shown when you buy.
- Web: the purchase is made through Stripe, and Stripe charges the card you gave it each year on the date you first subscribed.
Cancelling
You can cancel at any time. Cancelling stops the next renewal; live play keeps working until the end of the year you have paid for.
- App Store: on your iPhone or iPad open Settings, tap your name, then Subscriptions, and choose Open Hearts.
- Google Play: in the Play Store app, tap your profile picture, then Payments & subscriptions, then Subscriptions.
- Web: in the game, open Live play and choose Manage subscription, on any of the subscription's devices. That opens Stripe's billing page, where you can cancel, change the card, and see your receipts. If you no longer have any of those devices, email us (details below) with the email address you paid with, and we will cancel it and confirm.
Refunds
- App Store and Google Play: refunds are handled by Apple or Google under their own policies. For the App Store, request one at reportaproblem.apple.com. We cannot refund a store purchase ourselves.
- Web: contact us. Where the law where you live gives you a right to withdraw from the purchase or to a refund, you have it, and we will look fairly at any other request.
A refunded subscription stops being renewed, and live play on its devices ends when their current licence runs out, within about a month.
Your devices
Subscribing makes an account, and the subscription and its devices belong to it. There is no password, and the account plays live on one device at a time: opening the game on another of its devices moves live play there, and a game left on the first counts as one you left. If you clear the game's data or delete the app on your only device in the account, bring the new one in with a backup code, or by signing in with Apple or Google as before. Or contact us with the email address you paid with on the web, and we will help where we can.
At a live table
Your name and picture are public at a live table, as the privacy policy sets out. Do not put anything in them that you would not want a stranger to see.
You agree not to:
- use a name or picture that is hateful, sexual, violent, harassing or illegal, or that infringes someone else's rights;
- pretend to be another person, or to be us;
- harass, threaten or abuse other players;
- cheat: share cards with another player, play several seats at one table, or alter the game to gain an advantage;
- attack, overload or try to break the service, the relays, or other players' devices, or use them for anything but playing.
A player who stops playing can be booted by the table, and a bot takes the seat. A player who leaves a rated game finishes it last. You can hide another player's picture on your own device at any time.
To report a player or a picture, contact us (below). We may stop renewing live play for a device that breaks these rules, and if we do so without a good reason we will refund the unused part of a web subscription.
The code, and the name
The source code of Open Hearts is published under the MIT licence, and you may use, change and share it as that licence allows. That licence is about the code. It does not give you access to our live-play service, which these terms cover, and a game built from a copy of the code is its builder's, not ours. Please do not call a modified copy "Open Hearts" in a way that would make people think it comes from us.
No warranty
Open Hearts is provided "as is" and "as available". To the extent the law allows, we make no promises about it beyond those in these terms: not that it will be free of bugs or interruptions, not that it will suit a particular purpose, and not that servers run by other people will keep or delete anything.
Limits on our liability
To the extent the law allows, we are not liable for indirect, incidental or consequential loss, or for lost data, arising from your use of Open Hearts, and our total liability to you for anything arising from it is limited to what you paid us for live play in the twelve months before the claim, or five US dollars if that is more.
Nothing in these terms takes away rights you have under consumer law that cannot be taken away by agreement.
Ending these terms
You can stop using Open Hearts at any time, and cancel a subscription as described above. If we ever stop offering live play, we will stop renewals and say so here and in the app beforehand.
Law and disputes
These terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict-of-law rules. If you live in a country whose consumer law protects you more, that protection still applies. Please contact us first with any problem; most can be put right with an email.
Changes to these terms
If we change these terms, we will update this page and the date at the top. A change that matters to a subscriber applies from their next renewal, not in the middle of a year they have paid for. Earlier versions of this page are kept in the project's history on GitHub. These terms are also offered in other languages; where a translation differs from this English version, the English version applies.
